1. Agreement to These Terms
Welcome to HABITSBE.com (the “Website”), operated by Baseline Commerce, LLC, a Michigan limited liability company with its principal place of business at 3205 McKitrick Street, Melvindale, MI 48122 (“Baseline Commerce,” “we,” “us,” or “our”).
These Terms and Conditions (the “Terms”) govern your access to and use of the Website and any purchase of photographic landscape prints (“Products”) through the Website. By accessing the Website or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Website or purchase any Products.
Electronic contracting. You consent to transact with us electronically and to receive all notices, agreements, disclosures, and records relating to your order in electronic form, including by email and by posting on the Website. Your electronic assent — clicking “I agree,” “Place Order,” or a similar control — has the same legal effect as a handwritten signature under the federal E-SIGN Act and the Michigan Uniform Electronic Transactions Act. You may withdraw this consent by contacting us, but doing so means we can no longer accept your orders online. To retain a copy of any electronic record, print it or save it from your browser. You may also request a paper copy of any record we provide electronically, including the disclosure statement for a print, at no charge, by contacting us as described in Section 23. To access and keep our electronic records, you need a device with a current web browser and email, and the ability to print or save web pages. By placing an Order, you confirm that you can access records in this form. If these requirements change in a way that creates a material risk that you could not access or keep our records, we will tell you, and you may withdraw your consent at no charge.
Changes to these Terms. We may revise these Terms at any time by posting the revised Terms with an updated “Last Updated” date. Revised Terms apply prospectively only. The version of these Terms in effect at the time you place an order governs that order, and no later revision changes the terms of an order you have already placed. For material changes, we will post a prominent notice on the Website for at least thirty (30) days. Your continued use of the Website after a revision takes effect constitutes acceptance of the revised Terms as to future activity.
2. Definitions
• “Products” means photographic landscape prints offered on the Website, which may be open edition or limited edition prints, as specified in the applicable product description. Products are supplied as unframed, unmounted prints.
• “You” or “Customer” means the individual or entity purchasing Products or using the Website.
• “Order” means a request to purchase Products submitted through the Website.
• “Limited Edition” means a print produced in a stated, restricted quantity.
3. Eligibility and Use of the Website
3.1 Eligibility
You must be at least 18 years of age and have the legal capacity to enter into a binding contract to purchase Products. The Website is a general-audience site directed to adults and is not directed to children. If you are under 18, you may use the Website only with the involvement of a parent or guardian, who must place any order.
3.2 Account Information
You agree to provide accurate, current, and complete information at registration and checkout, and to keep it updated. You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account. Notify us promptly at marino.apollinari@gmail.com if you believe your account has been accessed without authorization. If you have saved a payment method to your account, keeping your credentials confidential matters all the more; see Section 6.3.
3.3 Website Content
The Website and its contents — including photographs, images, text, graphics, layout, and design — are owned by Baseline Commerce or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws. Except as expressly permitted in Section 11, you may not reproduce, distribute, publicly display, transmit, scan, frame, mirror, data-mine, scrape, or create derivative works from any Website content without our prior written permission.
4. Products, Descriptions, and Editions
4.1 Descriptions and Images
Product descriptions, images, and specifications are provided for illustrative purposes and are subject to change. We make reasonable efforts to display colors and detail accurately, but the color you see may vary from the printed Product because of your monitor calibration, ambient lighting, browser color management, paper stock, and normal printing tolerances. Color variation of this kind is inherent to photographic printing and is not a defect.
Digital origin and scaling. Our Products are made from digital photographic files. Where the printed size requires it, we scale the file to the printed size by interpolation before it goes to the laboratory. Interpolation calculates new pixel values from the pixel values already present; it does not introduce detail from any other source. In preparing a print file we use no generative or artificial-intelligence reconstruction, and we add, remove, or rearrange no content in the photograph. We make no representation that the file supplied to the laboratory is an unmodified original camera file. Where a Product is monochrome, the print file may be a monochrome rendering of a color capture. Any resolution stated in a product description refers to the print file at the printed size; it does not describe the camera that made the original capture, and it does not describe the resolution at which the laboratory's equipment exposes the paper. How fine detail resolves at the printed size is a characteristic of the photograph and of this process, and is not a defect.
4.2 Dimensions
Stated Product sizes are nominal and refer to the dimensions of the photographic image. Finished dimensions may vary by up to five percent (5%), both in the image and in the overall size of the sheet. Where a print includes a white border, that border is added outside the stated image dimensions and increases the overall outer size of the sheet; it does not change the size or format of the photograph itself. Product descriptions state the image size. If you need the overall sheet dimensions — for framing, for example — contact us before ordering, and we will provide them.
4.3 Limited Editions
Limited edition prints are produced in the quantity stated in the product description. The stated edition size is the total number of prints of that image that will ever be produced at that size in that edition. We do not produce artist’s proofs, printer’s proofs, or any other print outside the stated edition. Once an edition is sold out, we will not produce additional prints of that image at that size and in that edition, for commercial sale or otherwise. Each print is individually numbered on the print itself — for example, “12/50” — to reflect its place within the stated edition size.
4.4 Availability
All Products are offered subject to availability. We may discontinue, modify, or limit the quantity of any Product at any time before we accept an Order.
4.5 Required Disclosures
The information required by Michigan’s Art Multiples Sales Act (MCL 442.351 et seq.), California Civil Code Sections 1740 through 1745, and Article 15 of the New York Arts and Cultural Affairs Law appears in a disclosure statement on each product page, next to the description of the print, before you place your Order, and in a written disclosure statement shipped with each print.
5. Pricing, Fees, Taxes, and Errors
5.1 Prices
Prices are stated in United States Dollars (USD).
5.2 Price Transparency
The price displayed for a Product includes shipping and all mandatory fees and charges we impose, other than applicable taxes, which are calculated and disclosed separately before you complete checkout. We do not add mandatory service fees, handling fees, shipping charges, or surcharges at the end of the checkout process.
5.3 Taxes and Shipping
Sales, use, and similar taxes are calculated at checkout based on your shipping address and are your responsibility. Shipping costs are included in the displayed price at no additional charge.
5.4 Price Changes
We may change prices at any time. The price that applies to your Order is the price confirmed at checkout when you place the Order. A later price change does not affect an Order we have already accepted, and we will not charge you more than the confirmed price without your express consent.
5.5 Errors, Inaccuracies, and Omissions
The Website may occasionally contain typographical errors, inaccuracies, or omissions relating to price, description, availability, or dimensions. We reserve the right to correct such errors and to cancel or refuse any Order placed on incorrect information, even after the Order is submitted and payment authorized. If we cancel your Order for this reason, we will notify you promptly and issue a full refund of any amount charged within seven (7) business days. We will not charge you a corrected higher price without first contacting you and obtaining your express consent to the corrected price; if you do not consent, we will cancel the Order and refund you in full.
6. Orders, Acceptance, and Payment
6.1 Formation of the Contract
Your Order is an offer to purchase. Our acknowledgment email confirms that we received your Order; it does not constitute acceptance. A binding contract is formed only when we accept your Order, which occurs when we send you a shipment confirmation or otherwise expressly accept in writing.
6.2 Order Accuracy
By placing an Order, you confirm that you have reviewed the product description, including the stated dimensions and paper, and selected the intended image and quantity.
6.3 Payment
Payment is due in full at the time you place your Order through the payment methods offered at checkout. You represent that you are authorized to use the payment method you provide and that sufficient funds or credit are available. All payment card data is collected and processed by our PCI-DSS-compliant payment processors; we do not receive or store your full card number.
Saved payment methods. Our checkout gives you the option to save a payment method for future purchases. Saving a card is optional, and you can complete any Order without doing so. If you choose to save one, the card is stored by our payment processor and not by us; we continue to receive only the limited payment details described in Section 3.1 of our Privacy Policy, such as the card brand, the last four digits, and the authorization result. We use a saved card only for an Order you place and authorize. We do not charge a saved card on a recurring basis, and we do not charge it without your action. You may remove a saved payment method at any time through your account, or by contacting us at marino.apollinari@gmail.com, and we will remove it for you. Removing a saved card does not affect an Order we have already accepted.
6.4 Refusal of Orders
We may refuse or cancel any Order, in whole or in part, for legitimate business reasons, including suspected fraud, a payment authorization failure, an inability to verify billing or shipping information, an obvious pricing or description error, a shipping address outside the areas we ship to (Section 7.4), quantity limits, or unavailability. We do not refuse Orders on the basis of race, color, religion, national origin, sex, sexual orientation, gender identity, age, disability, familial status, or any other characteristic protected by federal, Michigan, or other applicable law. If we refuse or cancel an Order, we will notify you and refund any amount charged within seven (7) business days.
7. Shipping and Delivery
7.1 Shipment Timing
Our Products are printed to order by a professional print laboratory, delivered to us for inspection, and then shipped by us to you.
We ship Products to you within forty-five (45) days after we receive your properly completed Order, including authorization of your payment, unless a longer period is clearly and prominently stated in the product description at the time you place your Order. Our Products are made individually, and Orders are frequently shipped well before that period expires. The forty-five (45) day figure is the outer limit we commit to, not an estimate of how long your Order will take. If your payment is declined or reversed, the period starts again when we receive a valid payment.
7.2 Delay Notices and Your Right to Cancel
If we cannot ship within the applicable period stated in Section 7.1, we will notify you before that period expires. Our notice will state a definite revised shipment date or, if we cannot give one, say so and explain the reason for the delay; will offer you the option to consent to the delay or to cancel your Order and receive a full refund; will give you a cost-free way to respond; and will tell you expressly which of the following rules applies.
First delay of thirty (30) days or less. Where the revised date is thirty (30) days or less beyond the applicable period, if you do not respond, you will be deemed to have consented to the delay until the revised date. You nevertheless keep the right to cancel at any time before shipment.
First delay of more than thirty (30) days, or with no revised date. We will not proceed without your express consent. Unless we receive your express consent within thirty (30) days after the applicable period ends, your Order will be canceled automatically. If you consent to a delay with no revised date, you may still cancel at any time before we ship.
Further delays. If we cannot ship by a revised date to which you consented or were deemed to have consented, we will notify you before that date, stating a new revised date or that we cannot give one, and we will not proceed without your express consent. Unless we receive your express consent before that earlier revised date passes, your Order will be canceled automatically. If you consent to a further delay with no revised date, you may still cancel at any time before we ship.
Refunds. We will issue a full refund of everything you paid, including any sales tax, within seven (7) business days, without requiring you to ask for it, if: you cancel under this Section; your Order is canceled automatically under this Section; we do not ship by the applicable period or a revised date and you have neither consented nor been deemed to have consented to a later date; or we notify you that we cannot ship your Order and have decided not to. This Section reflects our obligations under the Federal Trade Commission’s Mail, Internet, or Telephone Order Merchandise Rule, 16 C.F.R. Part 435.
7.3 Delivery and Risk of Loss
Delivery is complete when the Product is delivered to the address you provided. Title and risk of loss pass to you upon delivery. Until then, the risk of loss or damage in transit is ours.
We recommend that you inspect the package on arrival and, where the carrier permits, note any visible damage on the delivery receipt. Doing so is helpful but is not a condition of your rights under Section 8. Your remedies for a Product damaged in transit are set out in Section 8 and are not waived by accepting delivery or by failing to note damage with the carrier. If a package never reaches you at all, see Section 7.6.
7.4 Shipping Destinations
We ship only to addresses within the United States and its territories, except Puerto Rico and the U.S. Virgin Islands. Our checkout does not block addresses in Puerto Rico or the U.S. Virgin Islands; if you place an Order to such an address, we will cancel it and refund everything you paid, including any sales tax, within seven (7) business days. We do not accept international Orders, and we do not ship to freight forwarders. We do not charge customs duties, import taxes, or import fees. Some U.S. territories impose their own excise, use, or import taxes on goods delivered there; any such tax is set and collected by the territory, not by us, and is your responsibility.
7.5 Undeliverable Packages and Incorrect Addresses
If a package is returned to us as undeliverable because of an address you supplied incorrectly, we will contact you. You may either pay the actual reshipment cost or cancel the Order. If you cancel, we will refund everything you paid, including any sales tax, less the actual outbound and return shipping costs we incurred. If a package is undeliverable through our error or the carrier’s, we will reship at our cost or refund you in full, at your election.
7.6 Lost Shipments
If carrier tracking does not show delivery within fifteen (15) days after we ship your Order, contact us, and we will treat the shipment as lost. At your election, we will either send a replacement at our expense or issue a full refund of everything you paid, including any sales tax. If a limited edition has sold out and a replacement is unavailable, we will issue a full refund. You do not need to file a claim with the carrier; we will do that.
Where tracking shows that the Product was delivered to the address you provided, risk of loss has passed to you under Section 7.3, and this Section does not apply. Contact us in any event, and we will help you trace the package with the carrier.
8. Returns, Refunds, and Damaged or Defective Products
PLEASE READ THIS SECTION CAREFULLY BEFORE ORDERING. IT DESCRIBES OUR RETURN POLICY AND LIMITS WHEN PRODUCTS MAY BE RETURNED. THIS POLICY IS ALSO POSTED AT CHECKOUT.
We also publish a plain-language Refund and Returns Policy on the Website, available at habitsbe.com/refund-and-returns-policy, which is incorporated into these Terms by reference. It is written to say the same thing as this Section 8. In the event of any conflict between the two, this Section 8 controls.
8.1 Change of Mind
Photographic prints are produced to order. We do not accept returns or exchanges for change of mind, buyer’s remorse, or a change in decorating plans. This limitation does not apply to Products that arrive damaged, defective, or not as described, which are covered by Section 8.2, and it does not affect any right you have under a law that cannot be waived. If a state law governing the sale of fine prints and photographs, such as Michigan’s Art Multiples Sales Act, gives you a right to return a print for a reason related to the information we are required to disclose, this limitation does not restrict that right, and we will honor it on the terms that law provides.
8.2 Damaged, Defective, or Non-Conforming Products
If a Product arrives damaged, defective, or not as described, notify us within fourteen (14) days of delivery at marino.apollinari@gmail.com. Please include your order number, a description of the problem, and photographs of the Product and, if the damage occurred in transit, the shipping carton and packing materials.
We will review your claim and, at your election, either replace the Product at our expense — including all shipping — or issue a full refund of everything you paid, including any sales tax. If a limited edition has sold out and a replacement is unavailable, we will issue a full refund. We will not require you to return a damaged Product at your own expense; if we ask you to return it, we will provide a prepaid shipping label.
If you discover a manufacturing defect that existed at delivery but was not reasonably apparent then — for example, delamination, ink bleed, or adhesive failure — notify us within fourteen (14) days of discovering it and within ninety (90) days of delivery, and we will apply the same remedies.
A change to the Product that arises after delivery from how it is stored, displayed, or handled, including storage in the shipping materials, is not a defect under this Section 8.2.
The rights in this Section 8.2 are our limited warranty, described in Section 9.1. They cover the condition of a Product when it reaches you; they do not promise any level of performance over time.
8.3 Refund Processing
Approved refunds are issued to the original payment method within seven (7) business days of our approval. Depending on your bank or card issuer, it may take additional time for the credit to appear on your statement.
8.4 Where This Section Does Not Limit You
Nothing in this Section 8 limits any right you have that cannot be waived under applicable law, including your rights under the FTC Mail, Internet, or Telephone Order Merchandise Rule, your rights to dispute a charge with your card issuer under the Fair Credit Billing Act, your rights under state laws governing the sale of fine prints and photographs, including Michigan’s Art Multiples Sales Act, or any non-waivable consumer protection right under the law of your state.
9. Warranties
9.1 Limited Warranty
LIMITED WARRANTY. Baseline Commerce, LLC warrants to the original purchaser of each Product that the Product will arrive free of damage and manufacturing defects and as described, including the information in our required disclosures (Section 4.5) and the statements described in Section 9.2.
Coverage period. This limited warranty begins on delivery and ends ninety (90) days after delivery. Damage, defects, or differences from the description that are apparent on delivery must be reported within fourteen (14) days of delivery. A manufacturing defect that existed at delivery but was not reasonably apparent then must be reported within fourteen (14) days of discovering it and within ninety (90) days of delivery.
What we will do. At your election, we will replace the Product at our expense, including all shipping, or refund everything you paid, including any sales tax. If a limited edition has sold out and a replacement is unavailable, we will refund you in full. If we need the Product back, we will send you a prepaid shipping label.
How to make a claim. Email marino.apollinari@gmail.com with your order number, a description of the problem, and photographs of the Product and, if the damage occurred in transit, the shipping carton and packing materials. You may also write to us or call us at the address and telephone number in Section 23.
What is not covered. Normal variation described in Sections 4.1 and 4.2; any change arising after delivery from storage, display, or handling, including storage in the shipping materials (Section 8.2); and performance over time. We make no promise that a Product will achieve any particular level of performance, longevity, lightfastness, or resistance to fading over any period of time.
Who is covered. This limited warranty is extended only to the original purchaser and does not transfer with a resold print (Section 11.2).
Incidental and consequential damages. WE ARE NOT LIABLE UNDER THIS LIMITED WARRANTY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
9.2 Statements in Product Descriptions
Any specific, factual statement we make on a product page about a Product — its paper stock, ink type, dimensions, edition size, or finish — is part of the description of that Product and we stand behind it. General or comparative language about photographic printing, and any third-party media or ink manufacturer’s published ratings we may reference, are informational and are not a promise by us about how a particular print will age in your home.
9.3 Implied Warranties
ANY IMPLIED WARRANTY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, IS LIMITED IN DURATION TO NINETY (90) DAYS FROM DELIVERY, THE DURATION OF THE LIMITED WARRANTY IN SECTION 9.1.
This limitation does not reduce the rights given to you by Section 8.
Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.
10. Disclaimer Regarding the Website
THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. THIS DISCLAIMER APPLIES TO THE WEBSITE ITSELF AND IS SEPARATE FROM THE TERMS ON WHICH PRODUCTS ARE SOLD.
11. Intellectual Property and Your License
11.1 What You Buy
You are purchasing a physical print. You are not purchasing the copyright in the photograph. All photographs and images reproduced in the Products and displayed on the Website remain the exclusive property of Baseline Commerce, LLC and are protected by United States copyright law.
11.2 What You May Do
Your purchase grants you full ownership of the physical print you bought. You may display it in your home, office, or place of business, including in a commercial space; lend it; give it away; and resell, donate, or otherwise dispose of that physical copy, consistent with your rights as the owner of a lawfully made copy under 17 U.S.C. § 109. The return and refund rights in Section 8 and the limited warranty in Section 9.1 run to the original purchaser only and do not transfer with a resold print.
11.3 What You May Not Do
Without our prior written permission, you may not: reproduce, copy, scan, photograph for reproduction, digitize, or otherwise duplicate the image; create derivative works from it; distribute copies of it; publicly display a reproduction of it; use the image in advertising, packaging, merchandise, or any product for sale; upload it to a stock library, print-on-demand service, or non-fungible token platform; or use it to train any artificial intelligence or machine learning model.
Incidental appearance of your print in the background of a photograph or video — for example, a real estate listing or a family photo — is permitted and requires no license.
11.4 Our Promotional Use
We may use images of our own photographs and Products in our marketing. We will not use a photograph you send us, your name, or any image of your home or property in our marketing without your separate, express, written permission. If you send us photographs to support a damage or defect claim, we use them only to evaluate that claim.
11.5 Enforcement
Unauthorized reproduction of our photographs may result in civil liability under the Copyright Act, including statutory damages and attorney’s fees. If you are interested in a commercial license, contact us — we are usually happy to discuss it.
12. Customer Submissions and Reviews
The Website does not accept customer reviews, ratings, comments, or other content for publication, and we do not display reviews or testimonials.
If you send us photographs or other material in connection with a damage or defect claim, we use it only to evaluate that claim, and we do not publish it. See Section 11.4.
Nothing in these Terms restricts you from posting an honest review of our Products or our business on any platform, and we will not ask you to. Any provision purporting to restrict an honest review would be void under the Consumer Review Fairness Act, 15 U.S.C. § 45b, and we make no such attempt.
13. Copyright Complaints
If you believe content on the Website infringes your copyright, send a notice under the Digital Millennium Copyright Act, 17 U.S.C. § 512(c)(3), to our designated agent: Marino Apollinari, Managing Member, Baseline Commerce, LLC, 3205 McKitrick Street, Melvindale, MI 48122; telephone 734-799-1677; email marino.apollinari@gmail.com. Your notice must include: (1) your physical or electronic signature; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the allegedly infringing material and its location on the Website; (4) your contact information; (5) a statement of good-faith belief that the use is not authorized; and (6) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on the copyright owner’s behalf. We will respond in accordance with the DMCA and may remove the material and terminate repeat infringers.
14. Prohibited Uses
You may not use the Website to: violate any law; infringe any intellectual property or privacy right; transmit malware or any harmful code; attempt to gain unauthorized access to the Website, our systems, or another user’s account; interfere with or disrupt the Website; scrape, data-mine, or use automated means to collect content or images; circumvent any technical protection measure; place fraudulent orders or use a payment method you are not authorized to use; or resell Products in a manner that misrepresents their origin, edition, or authenticity.
15. Limitation of Liability
PLEASE READ THIS SECTION CAREFULLY. IT LIMITS OUR LIABILITY TO YOU.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BASELINE COMMERCE, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE WEBSITE, THE PRODUCTS, OR THESE TERMS, INCLUDING LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR DAMAGE TO OTHER PROPERTY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO A PRODUCT OR ORDER WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THAT PRODUCT.
These limitations do not apply to, and we do not attempt to limit or exclude, liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; gross negligence or willful misconduct; any liability that cannot be limited or excluded under applicable law; or your non-waivable rights under state consumer protection statutes, including the Michigan Consumer Protection Act.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. This gives you specific legal rights, and you may also have other rights which vary from state to state.
16. Indemnification
You agree to indemnify and hold harmless Baseline Commerce, LLC and its members, managers, employees, and agents from any third-party claim, demand, loss, or expense, including reasonable attorney’s fees, arising out of your unauthorized reproduction or commercial use of our photographs, your violation of Section 14, or your violation of applicable law. This Section does not apply to any claim arising from our own acts or omissions, and it does not apply to a consumer to the extent prohibited by applicable law. We will notify you promptly of any claim and will not settle it without your consent.
17. Force Majeure
We are not liable for any delay or failure to perform caused by an event beyond our reasonable control, including natural disaster, fire, flood, severe weather, epidemic or pandemic, war, terrorism, civil unrest, labor dispute or strike, failure of a utility or telecommunications provider, carrier disruption, government action, or supplier failure. If such an event delays shipment, Section 7.2 governs your right to notice, consent, cancellation, and refund, and this Section does not limit those rights.
18. Governing Law and Dispute Resolution
18.1 Governing Law
These Terms and any dispute arising out of or relating to them, the Website, or the Products are governed by the laws of the State of Michigan, without regard to its conflict of laws principles. If you are a consumer residing in another state, this choice of law does not deprive you of the protection of any mandatory consumer protection provision of the law of your state of residence that cannot be derogated from by agreement.
18.2 Informal Resolution First
Before filing a claim, please contact us at marino.apollinari@gmail.com with a description of the dispute and the relief you seek. We will respond within thirty (30) days and will try in good faith to resolve the matter. Most issues are resolved this way.
18.3 Venue
If we cannot resolve a dispute informally, it will be brought exclusively in the state or federal courts located in Wayne County, Michigan, and you and we consent to the personal jurisdiction of those courts. This venue provision does not apply to a claim you bring in a small claims court of competent jurisdiction in your own county of residence, and it does not prevent you from filing a complaint with any government agency, including your state Attorney General or the Federal Trade Commission.
18.4 No Mandatory Arbitration
These Terms do not require you to arbitrate, and they do not waive your right to participate in a class action. You retain your right to a jury trial.
18.5 Time to Bring a Claim
Any claim arising out of or relating to these Terms or a Product must be brought within the period allowed by the applicable statute of limitations. We do not shorten that period.
19. Privacy
Your use of the Website is also governed by our Privacy Policy, available at habitsbe.com/privacy-policy, which is incorporated into these Terms by reference. The Privacy Policy describes the personal information we collect, how we use and disclose it, how long we keep it, and the rights and choices available to you, including how to opt out of targeted advertising and how we handle Global Privacy Control requests. In the event of any conflict between these Terms and the Privacy Policy regarding personal information, the Privacy Policy controls.
20. Accessibility
We are committed to making the Website usable by people with disabilities and work toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.2 Level AA. If you encounter a barrier or need help placing an order or accessing any Product information or policy, contact us at marino.apollinari@gmail.com or 734-799-1677, and we will assist you and provide the information in an accessible format at no charge.
21. Notice to California Residents
Under California Civil Code § 1789.3, California residents may reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
Our return policy is set out in Section 8 of these Terms and in our Refund and Returns Policy, and is posted conspicuously on the Website and at checkout, as contemplated by California Civil Code § 1723.
Where a Product is subject to a warning under California’s Proposition 65, that warning is provided on the product page before purchase and on or with the shipment.
22. General Provisions
Severability. If any provision of these Terms is held invalid, illegal, or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or if it cannot be, severed, and the remaining provisions will continue in full force.
No waiver. Our failure to enforce any provision is not a waiver of that provision or of our right to enforce it later.
Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets, on notice to you.
Notices. We may give you notice by email to the address associated with your Order or account, or by posting on the Website. You may give us notice at marino.apollinari@gmail.com or at the mailing address in Section 23.
Survival. Sections 7, 8, 9, 10, 11, 13, 15, 16, 18, and 22 survive termination of these Terms or completion of your Order.
Headings. Headings are for convenience only and do not affect interpretation.
Entire agreement. These Terms, together with the Privacy Policy, the Refund and Returns Policy, and the product description and order confirmation for your Order, constitute the entire agreement between you and Baseline Commerce, LLC regarding the Website and your purchase, and supersede any prior understanding on that subject.
No third-party beneficiaries. These Terms do not create rights in any person other than you and Baseline Commerce, LLC.

Decline, and your device keeps only what the site needs to work (your cart, your sign-in, and this choice), plus a few cookies and cached site files our platform sets either way (Privacy Policy, Section 5.5). Accept, and our platform also stores a 60-day visitor ID plus any ad click ID in your web address, and Google Analytics may store its own cookie and identifier, which is sent to Google. Our platform's Google Analytics tag loads either way, but declining stops it storing anything. No advertising or social media trackers.
